文具商標侵權 義烏一廠長栽在了第一筆大單上

從市場上批發(fā)貨物，貼上名牌標簽轉手就能賣高價，這樣的轉手買賣代價不小，一不小心就可能被判入刑。近日，義烏市工商局經檢大隊查獲了一起文具商標侵權案。

　　近日，義烏市工商部門執(zhí)法人員在義烏市西站一區(qū)某居民樓內，現場查獲90余箱標著“Winnie the pooh”、“Barbie”、“Hello Kitty”、“Mickey Mouse”等名牌商標的水彩筆、蠟筆、套裝畫筆。另查獲包裝盒等16000多個。由于當事人無法提供有效的授權文書，執(zhí)法人員當即予以扣留。

　　當事人陳某3月創(chuàng)辦了一家小型水彩筆加工廠。4月底，他接到一溫州客戶的訂單，指定要求包裝上述品牌，并告知貨物是發(fā)往俄羅斯的，利潤不小�！稗k廠以來第一次接到這樣的大生意”，陳某禁不住誘惑，就接了這筆大單。從義烏國際商貿城購進了一批普通文具，包上溫州客戶提供的印有名牌商標的包裝盒，準備發(fā)往俄羅斯。但還沒來得及發(fā)貨，就被工商部門查獲。

　　據執(zhí)法人員透露，陳某侵犯了5種注冊商標專用權，非法經營額超過3萬元，根據相關法律規(guī)定，已夠到刑事責任追訴標準，并應予立案追訴。近日，執(zhí)法人員已將該案依法移送至公安機關，做進一步的調查處理。

　　工商部門提醒，生產廠家和銷售商家必須要牢固樹立知識產權保護意識，沒有授權的注冊商標絕對不能加工。如果對有些商標不能確定是否注冊，可以通過中國商標網，點擊網頁內的相應類別產品來查實商標的各種資料，包括持有人、注冊內容、注冊時間、有效期等等，還可以及時向工商部門咨詢。
